Terms of Service

By downloading, installing, or using the Onpace app or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service.

To use certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately at admin@usport.ai if you become aware of any unauthorized use of your account.

Onpace offers the following auto-renewable subscription plans (“Pro”) through Apple’s App Store:

• Onpace Pro Monthly — 1 month — $49.99 per month, auto-renewing.
• Onpace Pro Annual — 1 year — $549.99 per year, auto-renewing.

Pro unlocks personalized training plans from real coaches, detailed progress tracking, and priority coach replies. Prices are shown in the app at the time of purchase and may vary by region. By subscribing, you agree to the following:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• You can manage and cancel subscriptions in your device’s Settings › Subscriptions.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

All payments are processed by Apple. Refund requests must be directed to Apple through their standard process.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Impersonate another person or misrepresent your identity
• Upload or transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to send spam or unsolicited communications

We reserve the right to suspend or terminate your account if you violate these Terms.

You retain ownership of the content you create and upload to the Service, including workout data, messages, photos, and videos. By uploading content, you grant us a limited, non-exclusive license to store, display, and process that content as necessary to operate the Service.

You are solely responsible for the content you upload. We may remove content that violates these Terms or is reported as inappropriate.

The Service, including its design, features, code, and branding, is owned by USPORT AI INC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand elements.

Onpace uses artificial intelligence to generate training plans and workout adjustments. AI-generated content is provided as a tool to assist your training and should not be considered medical or professional coaching advice. Always consult a qualified professional before starting any new exercise program, especially if you have health concerns or injuries.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. Your use of the Service is at your sole risk.

To the maximum extent permitted by law, USPORT AI INC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, whether based on warranty, contract, tort, or any other legal theory.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You may delete your account at any time from the Profile screen in the app. When you delete your account, all your personal data, workouts, plans, and progress will be permanently removed. This action cannot be undone.

If you have an active subscription, deleting your account does not automatically cancel it. Please cancel your subscription through your device’s Settings › Subscriptions before deleting your account.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you through the Service or by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Hillsborough County, Florida.
